Terms of Service

1. Acceptance of Terms

By accessing or using FlowMatch ("the Platform", "we", "us"), operated by ArivonAI, you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform. These Terms apply to all visitors, agency applicants, and other users.

2. What FlowMatch Is — and Is Not

FlowMatch is a directory and lead-generation marketplace. We list AI automation agencies so that business owners can discover and contact them. FlowMatch is not a party to any agreement between a business owner and an agency. We do not provide, manage, or guarantee any AI automation services listed on the Platform.

All agency listings are independently operated businesses. Any contract, project, payment, or dispute is strictly between the business and the agency. FlowMatch has no involvement in, and accepts no liability for, any such arrangement.

3. Agency Listings

Agencies may apply to be listed on FlowMatch by submitting an application. All applications are reviewed before approval. By applying, you represent that:

• All information provided is accurate and not misleading.
• You have the right to offer the services you describe.
• You will maintain the accuracy of your listing and notify us of material changes.
• You are not impersonating another person or entity.

We reserve the right to approve, reject, suspend, or permanently remove any listing at our sole discretion, for any reason, at any time, with or without notice.

4. Reviews

Business owners may submit reviews of agencies. By submitting a review, you represent that:

• You have an actual business relationship with the agency you are reviewing.
• Your review reflects your genuine experience.
• Your review does not contain false, defamatory, or misleading information.
• You grant FlowMatch a non-exclusive, royalty-free license to display your review.

Reviews are moderated. We may decline to publish or remove reviews at our discretion.

5. Prohibited Conduct

You agree not to:

• Submit false, fraudulent, or misleading information.
• Use the Platform to harass, defame, or harm any person or business.
• Scrape, crawl, or systematically extract data from the Platform without written consent.
• Circumvent or attempt to circumvent any security or access controls.
• Use the Platform for any illegal purpose under applicable law.
• Infringe any intellectual property rights of FlowMatch or any third party.

6. Intellectual Property

The FlowMatch name, logo, design, and all content created by us are owned by ArivonAI and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written permission.

Agency listings, reviews, and other user-submitted content remain the property of their respective owners. You grant FlowMatch a non-exclusive license to display that content on the Platform.

7. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. WE MAKE NO REPRESENTATIONS ABOUT THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY AGENCY LISTING OR REVIEW.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ARIVONAI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED ONE HUNDRED CANADIAN DOLLARS (CAD $100).

9. Indemnification

You agree to indemnify, defend, and hold harmless ArivonAI and its officers, directors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; or (c) any content you submit to the Platform.

10. Third-Party Links

Agency profiles may contain links to third-party websites (e.g., agency websites, Calendly booking pages). We do not control and are not responsible for any third-party websites or services. Accessing third-party links is at your own risk.

11. Modifications to the Platform and Terms

We reserve the right to modify, suspend, or discontinue the Platform at any time without notice. We may also update these Terms at any time. Your continued use of the Platform after any changes constitutes acceptance of the updated Terms.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Province of Quebec, Canada, without regard to conflict-of-law principles. Any disputes arising from these Terms or your use of the Platform shall be resolved in the courts of Montreal, Quebec, Canada.
